【 台北法的外交意涵 】

Taiwan Allies International Protection and Enhancement Initiative (TAIPEI) Act of 2019簡稱為《台北法》，這法案剛出來時，我曾經說這是美國國會首度將台灣的國際參與與盟邦寫入他們的國內法，意義遠比Taiwan Travel Act（台灣旅行法）來的重大。
直到今日，好事成真。
想要知道這法案細節的，可以看中央社或其他媒體報導，摘譯都出來了。
這邊談談外交意涵。
第一，川普待會要跟習近平通電話。挑在打電話之前簽署這項法案，你只能說阿川的心機不是普通重。
這是典型的外交籌碼運用。這法案縱使川普不簽，很快也會自動生效。但他就選在跟習近平通電話前簽了。
川普想要什麼？當然是希望這通電話能從中國手中拿到好處。
第二，如果WHA今年五月如期召開，美國代表或美方會有什麼具體措施來協助台灣參與？
《台北法》明定：
It should be the policy of the United States--
(1) to advocate, as appropriate--
(A) for Taiwan's membership in all international organizations in which statehood is not a requirement and in which the United States is also a participant; and
(B) for Taiwan to be granted observer status in other appropriate international organizations;
意思就是：
那些不需要以國家會員為前提的國際組織，美國應該要鼓吹台灣成為會員。
至於其他合適的國際組織，在美國也有參與的前提下，美國應該要鼓吹台灣成為觀察員。
這裡有個tricky的陷阱：appropriate。而我相信，台灣參與WHO絕對是appropriate。
第三，台灣的邦交國目前是15個。在《台北法》通過後，美國等於對台灣的邦交國數字有了無形的道德壓力。
《台北法》明定：
It is the sense of Congress that the United
States Government should--
(1) support Taiwan in strengthening its official diplomatic relationships as well as other partnerships with countries in the Indo-Pacific region and around the world;
(2) consider, in certain cases as appropriate and in alignment with United States interests, increasing its economic, security, and diplomatic engagement with nations that have demonstrably strengthened, enhanced, or upgraded relations with Taiwan; and
(3) consider, in certain cases as appropriate, in alignment with United States foreign policy interests and in consultation with Congress, altering its economic, security, and diplomatic engagement with nations that take serious or significant actions to undermine the security or prosperity of Taiwan.
這段寫的非常拗口，但其實就是三句話：
1. 美國應該支持台灣在印太地區及全世界的外交關係。
2. 跟台灣好的國家，美國應該考慮也跟他們好。
3. 跟台灣不好的國家，美國應該考慮不跟他們好。
我刻意翻地很直白，法案文字當然更細緻加了一堆但書，但這段的架構就是這個意思。
也就是說，《台北法》成真後，中共每搶一個台灣邦交國，就可能違反美國國內法，美方行政部門也必須跟國會部門報告，美方做了什麼以及需要做什麼來預防類似狀況發生。
換句話說，日後中共要搶台灣邦交國，必須更加謹慎。不是說不會發生，而是美國已經正式將台灣的邦交國狀態納入美國國內法，而這代表著極高法律拘束力。
第四，美國的一中政策內容會不會改變？
在過去，美國的「一中政策」不等於中國的「一中原則」。
美國的「一中政策」，多年來就是三個公報（1972年上海公報、1979年建交公報與1982年817公報）以及1979年台灣關係法，後來又加上1982年雷根總統的「六項保證」。這其中，只有台灣關係法是美國國內法。
在川普上台後，2018年美國國會通過《台灣旅行法》（Taiwan Travel Act），台旅法雖然也是美國國內法，但整體而言並未改變美國官方一中政策的基調。
但現在《台北法》通過後，顯然對美國的一中政策實質內容有了顯著的改變。
我們可以觀察的是，美方往後談到一中政策時，會不會開始變成「三個公報 + 台灣關係法+六項保證+台旅法+台北法」？
無論美方有無改變對一中政策的官方說法，但美國的一中政策已經非常明顯地越來越向台灣傾斜。
