CLOSE DOWN OF THE MARINA CLUB
Dear DB residents,
You may be aware that the Marina Club issued a notice on 31 August 2018 giving members 4 months’ notice that all debentures would be redeemed and the Marina Club closed for unspecified major renovations. All boats are required to be removed from the Marina by 31 December 2018. This will make around 200 families, our neighbours, homeless.
There has been speculation for many years that Hong Kong Resort Co Ltd (HKR) is planning to fill in the marina and develop the area (see HKR’s submission to Legco in April 2016:

Last week, HKR International Limited’s Deputy Chairman and Managing Director, Mr Victor Cha, spoke to the press urging the Government to relax the plot ratio in Discovery Bay.

I want to stress that, ultimately, development in DB is not limited by the land, the plot ratio or the Government. Rather, development is limited by the number of undivided shares remaining for allocation to residential development under the Deed of Mutual Covenant (DMC). The DMC sets strict limits, and I estimate that some 70-80% of the undivided shares have already been used for the existing development.
Unfortunately, there is no proper record of how many undivided shares have been used and how many remain. To complicate matters, over the past 20-odd years, undivided shares have been under-allocated to new phases. Undivided shares should have been allocated on the basis of GBA as defined in the DMC. However, HKR has allocated undivided shares on the basis of GFA, which allows for floor area concessions that are not applicable to GBA. This has enabled HKR to retain extra undivided shares for future development.
Before Lands Department considers HKR’s application for further development in DB, the undivided share issue must be resolved. If it is not resolved, we must object.
The problem rests with HKR and their refusal to clarify how many residential development undivided shares remain under the DMC. The issue was discussed at the City Owners’ Committee (COC) meeting last Wednesday, 29 August 2018. I suggested that City Management, i.e. Discovery Bay Services Management Ltd, a subsidiary of HKR, hire an independent Authorized Person (AP) to clarify the matter. However, the representatives of City Management at the meeting refused to act.

我重申愉景灣發展並非受制於土地、地積比率或政府,而是公契中訂定的住宅發展的不可分割業權。公契明確指出發展限度,我估計已發展的住宅用地約佔可用的不可分割業權的70%至80%。
遺憾的是,已批出或仍未批出的不可分割業權並無記錄在案。更甚者,過去20年的發展過程中,不可分割業權一直被低估。公契要求以GBA分配不可分割業權,但興業卻以有地積括免的GFA取代,從而獲得更多可作發展的不可分割業權。
我們要求香港興業向地政總署提出發展愉景灣申請前,必須先解決不可分割業權的問題,否則我們一定反對到底。
香港興業一直拒絕公開公契下剩餘的住宅發展的不可分割業權數目,8月29日(星期三)的城市業主委員會會議中就此討論,我建議由管理公司,即愉景灣服務管理有限公司(香港興業的附屬公司)聘請一名獨立授權人士處理,惟遭席上的管理公司代表反對。
希望愉景灣居民齊心保衛自己權益及家園,並支援一班被遊艇會迫遷的鄰居。
